Book a MIAM: 5 Things to Consider First

If you are planning to book a MIAM, it helps to understand a few key points before you go ahead. A MIAM (Mediation Information and Assessment Meeting) is often the first formal step before applying to court and it also helps you decide whether mediation is suitable for your situation.

At Family Mediation Services, an accredited mediator will help get you through the process and explain your options clearly.  Below are five important things to consider before you book a MIAM appointment.


Before you book a MIAM, you should decide whether you will pay privately or apply for legal aid. This choice can affect timing, cost, and how many sessions you may receive for free.

  • You may be eligible for the mediation voucher but not for legal aid
  • You may be eligible for both the mediation voucher and legal aid
  • Delays in a legal aid application can range from three days to three weeks, depending on how quickly you can supply evidence electronically
  • The mediation voucher provides up to two free joint sessions
  • Legal aid can cover up to three free joint sessions
  • The fee for a MIAM starts from £85

When you request family mediation, the office will explain your eligibility and confirm what evidence is required.


2. Do you want us to contact the other side immediately?

When you request a MIAM appointment, you may want the other party contacted straight away. This option is only available to private-paying clients.

However, if you are using legal aid, we cannot contact the other side until your MIAM has taken place.  An accredited mediator at Family Mediation Services will will normally contact the other side, on the day of your MIAM, once you have confirmed you are happy to do so.


3. Is there an urgent or emergency issue?

In some urgent or emergency situations, you may not need mediation at all. For example, cases involving immediate risk, unlawful removal of a child, or serious safeguarding concerns may be unsuitable.

At a MIAM, the mediator will assess whether mediation is appropriate.  If mediation is not suitable, the mediator can confirm this for court purposes, or you may wish to ask a solicitor for advice before you book a MIAM.


4. Would you prefer a video or telephone MIAM?

When booking a MIAM, you can usually choose between a video or telephone appointment. At Family Mediation Services, our mediators can accommodate both options.

MIAMs are not generally carried out in person. If you are unsure which format suits you best, you can discuss this when you request family mediation or arrange your initial appointment.


5. Are you at risk of harm from the other party?

If engaging in mediation could place you at risk of danger, mediation may not be suitable. Your safety always comes first.

An accredited mediator will explore this carefully during the MIAM. If mediation is not appropriate, the mediator will explain why and help you understand your next steps.

During the MIAM, the accredited mediator will assess suitability for mediation, explain the process, and confirm your fees and any free sessions available.
