Updating Your MIAM certificate for your Form C100 explained

Updating Your MIAM certificate for your Form C100 explained

If you need to update your MIAM certificate on your Form C100 to apply for a Child Arrangements Order in England or Wales, it’s important to understand the process and timing. Courts require anyone applying for a child arrangements court order to attend a MIAM (Mediation Information and Assessment Meeting) within four months of submitting their application. This is to make sure you’ve tried mediation before turning to the court. Here’s a clear guide to help you through the process smoothly.

How do I Get A MIAM Certificate? Four Ways to Speed Up the Process

1. Keep Your MIAM Certificate Up-to-Date

If your MIAM certificate is older than four months, you’ll need to update it. At Family Mediation Services, returning clients can easily update their C100 certificate for £45. This includes contacting the other parent to invite them to mediation.

2. Let the Mediator Handle Communication

Your mediator will contact the other parent to invite them to mediation. If they agree, you can move forward with a joint session. If they refuse, the mediator can quickly reissue your MIAM certificate so you can proceed with your application.

3. Mediation in Parallel with a Court Application

Sometimes, individuals prefer to apply to court while starting mediation simultaneously. This approach ensures that the court process isn’t delayed if the other party is uncooperative or if mediation takes time. If you reach an agreement during mediation, you can either withdraw your court application and rely on the mediated agreement or submit a consent order to the court, closing the contested case.

If you’re using legal aid, you’ll need to meet with the same mediator who conducted your original MIAM to get an updated certificate.

If you qualified for legal aid, you’ll need to resubmit proof of your eligibility, like evidence of benefits or low income, and complete the necessary forms. Having these documents ready will help avoid any delays in getting your MIAM certificate.
