How to Get a MIAM Certificate

1. Attend a MIAM with an Accredited Mediator

The first step is to meet with a mediator.  Many mediators come from legal backgrounds but they remain completely neutral.  They do not represent either side or offer legal advice. Instead, they help you understand your options and decide whether mediation is suitable.

At Family Mediation Services, a MIAM (mediation information and assessment meeting)  is one of the most affordable routes to obtaining a MIAM certificate. Only one person needs to attend and fees start from £85.  During the meeting, the mediator will explain the process and check whether you qualify for a MIAM exemption certificate.

If you are not exempt, the mediator can help you move forward with the mediation process. In some cases, this can also be low-cost or free through the government voucher scheme or legal aid.

2. Obtain a MIAM Certificate for a C100 Application

If mediation is not suitable or if the other person refuses to attend, your mediator can issue a MIAM certificate. This certificate allows you to complete and submit Form C100 to the family court. You only need this certificate when a MIAM is required and no exemption applies.

3. Consider Arbitration as an Alternative

If you prefer a binding decision without going to court, you can choose arbitration. Arbitrators are also legally trained professionals but they issue a final and independent decision for both parties.

Arbitration is more expensive and fees usually start at around £3000, but some families choose it when they want a final resolution or when mediation is not appropriate.

4. When You Should Not Seek a MIAM Certificate

You would not need a MIAM certificate if you have recently experienced domestic abuse and it is unsafe for you to participate, even in shuttle mediation. In these situations, you may qualify for an exemption and, if you do attend the MIAM meeting, the mediator will confirm that you qualify.  Your safety always comes first.
